IEEE-USA petitions FCC for spectrum ruling to spur new technologies

IEEE-USA, in a petition filed today with Federal Communications Commission, is asking the federal government to classify frequency spectrum above 95 GHz "a new technology or service."

Such a declaratory ruling, according to IEEE-USA, would spur capital investment and lead to long-term commercial opportunities. A similar ruling 28 years ago led to the development of Wi-Fi (IEEE 802.11), a wireless technology that has transformed the way we live, work and communicate.

"The rules that led to Wi-Fi were adopted in 1985, and it took to about 2000 for Wi-Fi to hit the market," said Mike Marcus, chair of the IEEE-USA Committee on Communications Policy.

"We're asking the FCC to set the stage for technology development that could have a big impact on the economy."

No FCC service rules above 95 GHz leads to regulatory uncertainty and hesitancy on the part of venture capitalists and angel investors to invest in new technologies at that frequency spectrum. This deprives the public and private sectors of the potential benefits of innovative technologies.

"When you remove prohibitions to new technology, interesting things happen," Marcus said. "In radio regulation, there were anachronistic limits that made sense 30 years ago that don't make sense today. We are urging the FCC to start removing those barriers to innovation."

Marcus added that a positive ruling from the FCC would help U.S. wireless companies compete with international firms that have access to government funding. The petition cites a Singapore government-financed research laboratory announcement that its 135 GHz antenna technology can support wireless speeds more than three times faster than the fastest Wi-Fi today.

"Many foreign companies have near-zero risk because they work hand-in-glove with their government," he said. "So when they develop a product, they know they get market access and they know their government will support them on the international stage. In the United States, companies that deal in this don't work hand-in-glove with the U.S. government.

"We think our system is better, but unless all parts of it work together and get rid of barriers, we won't get investment in the technology, and foreign competitors will take the lead and reap the benefits."

Xbox One to let gamers scan download codes using Kinect

Many console gamers know the drudgery of entering a download code with a gamepad or keyboard. Now that Kinect is part and parcel of the Xbox One experience, however, they'll always get to skip that step: Microsoft's Marc Whitten has revealed that system owners can scan the codes with the Kinect camera. While this is really an extension of what the original Kinect can do -- Kinectimals takes advantage of QR codes, for example -- it should be a big help for gamers who'd rather be playing than typing.

Banks Are Ditching Switzerland - Business Insider

Switzerland?? long famous for storing money and not asking any questions?? has been beefing up scrutiny on banks enjoying shelter in the Alpine paradise's lax regulatory structure, Businessweek reports.

And foreign private banks in Switzerland are now heading for the exits.

The number of foreign-owned Swiss banks fell to 129 by the end of May from 145 at the start of 2012, according to data from the Association of Foreign Banks in Switzerland. Assets under management slid by a quarter to 870.7 billion Swiss francs ($921 billion) in the five years through 2012 as clients withdrew money or paid taxes on undeclared accounts, the data show.

Switzerland houses 26% of global offshore wealth, or about $2.2 trillion, according to Businessweek. U.S. and EU pressure sparked the new crackdown.

The U.S. has been investigating Swiss banks and units of foreign banks in the country, including that of London-based HSBC, after UBS AG (UBSN) in 2009 avoided prosecution by admitting it fostered tax evasion and delivering data on about 4,700 accounts of Americans. France and Germany have been searching for tax dodgers using data stolen from Swiss banks and also sharing some of the information with authorities in other European countries.

British mortgage giant Lloyds Banking sold its international banking business to a Swiss company in May. And sources told Businessweek that more banks are reviewing their presence in Switzerland and weighing if and how to leave.

Immigration bill faces uncertain future in House

WASHINGTON (AP) ? The immigration debate is shifting to the Republican-led House, where lawmakers have shown little appetite for the large-scale, comprehensive approach their Senate colleagues embraced last week.

The Republican chairman of the House Judiciary Committee said Sunday that any attempt at comprehensive immigration legislation cannot offer a "special pathway to citizenship" for those in the United States illegally. Democrats have called that position a deal-breaker.

Meanwhile, both parties eyed the politics that could yield electoral victories or irrelevance among the growing Hispanic voting bloc.

Rep. Bob Goodlatte, the Virginia Republican who leads the House Judiciary Committee, said he does not foresee a proposal that could provide a simple mechanism for immigrants here illegally to earn full standing as U.S. citizens. His committee members have been working on bills that address individual concerns but have not written a comprehensive proposal to match the Senate's effort.

A pathway to legal standing, similar to that of immigrants who have green cards, could be an option, he said.

Unacceptable, said Sen. Chuck Schumer, D-N.Y.

"No Democrat will vote for any bill without a path to citizenship," said Schumer, who helped write the Senate immigration plan that passed that chamber last week.

The Senate bill would provide a long and difficult pathway to citizenship for those living in the country illegally, as well as tough measures to secure the border. In the Democratic-controlled Senate, 14 Republicans joined all Democratic senators and independents in the 68-32 vote.

In the Republican-led House, conservatives have stood opposed to any pathway to citizenship for those workers. House lawmakers have urged a piecemeal approach to the thorny issue instead of the Senate's sweeping effort. House Speaker John Boehner has ruled out taking up the Senate bill and said the Republican-controlled chamber would chart its own version of the legislation with a focus on border security.

Illustrating the strong opposition among conservative lawmakers, Rep. Trey Gowdy, R-S.C., said flatly: "The Senate bill is not going to pass."

If immigration falls, so too could the GOP's national prospects.

Sen. John McCain, the 2008 Republican presidential nominee and an author of the current Senate immigration bill, said "Speaker Boehner has a tough job ahead" to convince his caucus to act.

"Republicans realize the implications of the future of the Republican Party in America if we don't get this issue behind us," McCain said.

House Democratic leader Nancy Pelosi similarly predictied electoral doom if Republicans thwart the efforts to address the estimated 11 million immigrants now in the United States illegally. She said Republicans should follow the Senate's lead "if they ever want to win a presidential race."

"We wouldn't even be where we are right now had it not been that 70 percent of Hispanics voted for President Obama, voted Democratic in the last election," Pelosi said. "That caused an epiphany in the Senate, that's for sure. So, all of a sudden now, we have already passed comprehensive immigration reform in the Senate. That's a big victory."

In 2012, Obama won re-election with the backing of 71 percent of Hispanic voters and 73 percent of Asian-American voters. A thwarted immigration overhaul could again push those voting blocs toward the Democrats' side.

If an immigration bill fails, Democrats stood ready to blame Boehner and his party.

"Will he allow a small group, maybe even a majority of his caucus, to control the debate and the future on this issue?" asked Rep. Luis Gutierrez, D-Ill. "If he decides to do that, we will then end in a stalemate and an impasse once again."

Goodlatte and Gutierrez spoke to CNN's "State of the Union." Schumer, Gowdy and McCain were on "Fox News Sunday." Pelosi was on NBC's "Meet the Press."

NYC's gay pride march celebrates Supreme Court win

NEW YORK (AP) ? The 84-year-old woman at the center of the U.S. Supreme Court decision granting gay couples federal marriage benefits is a grand marshal of New York City's gay pride march.

Edith Windsor plans to walk up Fifth Avenue starting at noon Sunday. It's been 44 years since the city held its first pride march but only days since the Supreme Court used Windsor's lawsuit to strike down the provision of an act that defined marriage as between a man and a woman.

Also serving as this year's grand marshal is musician and activist Harry Belafonte.

The third grand marshal is Earl Fowlkes, head of the Center for Black Equity, which works in the African-American lesbian, gay and transgender community.

This year's theme is titled Rain to Rainbows.

The agency has not received official word from the unions about a?strike, but it must caution riders that a?strike may begin after the end of Sunday night's regularly scheduled service,?BART?spokesman Rick Rice said in a statement.

He urged the unions to resume contract talks, noting that all parties had agreed on several issues when they returned to the bargaining table Sunday afternoon in an 11th hour attempt to avoid a walkout.

"We should use that momentum to reach a deal," the statement said.

Calls to the representatives from Service Employees International Union Local 1021 and Amalgamated Transit Union Local 1555 were not immediately returned.

A?strike?would cripple the region's Monday morning commute. Transportation officials say another 60,000 vehicles could be on the road, clogging highways and bridges throughout the Bay Area.

The unions' contracts are set to expire at midnight.

As the deadline neared, both sides said they were far apart on key sticking points including salary, pensions, health care and safety. Anticipated around-the-clock negotiations had fallen apart Saturday as the unions packed up and left after talks stalled amid claims that the parties met face-to-face once in 36 hours.

Sunday's last-ditch talks also came after Gov. Jerry Brown's secretary of the Labor and Workforce Development Agency, Marty Morgenstern, requested the parties continue negotiating to prevent a work stoppage of the nation's fifth-largest rail system.

"Our team is not encouraged by?BART's?proposal, but we are going to bargain at the request of the labor secretary in good faith as we have all along," said Josie Mooney, an SEIU chief negotiator. "But if?BART?continues to do 'surface bargaining,' then we will not come to an agreement."

Brown spokesman Evan Westrup said Sunday that the governor will not call for a "cooling off period at this time" as state mediators will continue assisting the negotiating parties.

"BART?and its labor unions owe the public a swift resolution of their differences," Westrup said. "All parties should be at the table doing their best to find common ground."

The two unions, which represent nearly 2,400 train operators, station agents, mechanics, maintenance workers and professional staff, want a 5 percent raise each year over the next three years.

BART?said that train operators and station agents in the unions average about $71,000 in base salary and $11,000 in overtime annually. The workers also pay a flat $92 monthly fee for health insurance.

Rice said?BART's?latest proposal offered a total of an 8 percent salary raise over the next four years, instead of its original offer of a total of 4 percent over the same period. The proposed salary increase is on top of a 1 percent raise employees were scheduled to receive Monday, Rice added.

The transit agency also said it offered to reduce the contribution employees would have to make to their pensions, and lower the costs of health care premiums they would have to pay.

Rice said Sunday that?BART's?latest proposal may not be its best last offer.

"We need to have some substantial discussions," Rice said. "I hope we can make some progress."

BART's?last?strike?lasted six days in 1997. The transit agency handles more than 40 percent of commuters coming from the East Bay to San Francisco with the Bay Bridge handling another 50 percent said John Goodwin, a spokesman for the Metropolitan Transportation Commission.

Goodwin said commuters should consider carpooling, taking extra buses or ferries available and working from home if the trains stop. And, if commuters must drive to work, leave earlier or even later than usual, he said.

"We simply don't know what the status is," Goodwin said. "Unfortunately, we have to go with the assumption that BART?will not be in operation."

Meanwhile, commuters such as Richard Graham, 43, of Pleasant Hill who works as a hotel banquet manager in downtown San Francisco, is left pondering his options, including a three-hour drive to work.

"I can't stop thinking about it," Graham said Sunday as he got off a train. "It would make take me 2 ? to 3 hours if I drive in to work. Then I've got to find parking, and that might cost me another 40 bucks, if there are any spots left."
