Floods in Britain Highlight Insurance Dispute

And things may get worse, as the British government and British insurers battle over a deal that would provide state guarantees for flood coverage at a time when losses are expected to rise because of global warming.

With more storms on the way, the government and the insurance industry are engaged in mutual finger-pointing. Insurers say the government is failing to provide homeowners the type of guarantees that other European countries and the U.S. do, while the government is accusing the industry of whipping up people?s fears by publicizing its negotiating position even before flood waters have receded.

If a deal isn?t struck by the end of June, as many as 200,000 people in Britain could either lose their insurance or find it too expensive to pay premiums that are certain to rise without government guarantees.

All this comes as the European Environment Agency reported that global warming has caused an overall rise in sea levels globally and along most of the region?s coasts. There has also been an increase in flooding along streams and rivers.

Floods and storms account for around two-thirds of the costs for natural disasters, the agency concluded. And those costs continue to rise.

?The contribution of climate change to the damage costs from natural disasters is expected to increase in the future due to the projected increase in the intensity and frequency of extreme weather,? the report said.

Mindful of the trend, British insurers want to place a surcharge on all insurance premiums to create a new funding pot to cover flooding claims. But until that fund is built up, they want the government to back a temporary overdraft to cover any shortfalls during periods of intense flooding. So far, there?s no deal, and people watching floodwaters rise across the country have become uneasy.

?Negotiations have hit an impasse,? Nick Starling, the director of general insurance at the Association of British Insurers said in a statement. ?Insurers know their customers are increasingly worried about flood cover and we will therefore continue talks with government to try and find a way forward.?

The government says the door is still open to an agreement, but declined to get into the specifics. But it did take time to criticize the timing of the industry?s announcement, coming as heavy rains swept across the country and forced the evacuations of hundreds of homes.

Environment Secretary Owen Paterson said raising the issue of insurance was causing alarm unnecessarily.

?I think the timing was unhelpful,? he told BBC on Monday. ?There are a lot of people across the country who are going to face some very bad weather over the next few days. Many people are extremely worried, and I think it is not helpful to alarm people when we are in close, detailed negotiations.?

Prime Minister David Cameron raced to flooded areas Tuesday to underscore his concern. But with images of furniture floating down streets and cars lurching in torrents of mud, the argument that more needs to be done to help people recover is tough to ignore.

Governments around the world have responded to the problem of flooding in different ways. In Germany, coverage for flooding is offered as an optional add-on for household insurance with some 30 percent who need it going to private insurers ? although the state has stepped in to help after big disasters. In the United States, the government partly backs flood insurance for high risk households, as does France, the insurers? group said.

In the Netherlands, home of the legendary boy who held back floodwaters by placing his finger in a dike, flood risk is normally excluded from property insurance policies due to the high potential loss. The Dutch state will pay compensation under some circumstances to those suffering losses that the market does not insure, though there are limits.

The National Flood Forum, a U.K. charity that represents people who are at risk of flooding, hopes that the latest troubles will finally persuade ministers and the industry to strike a deal. Talks on a plan have been going on for years and without an agreement people will struggle to get insurance and to deal with the consequences, said Paul Cobbing, the group?s chief executive officer.

?The floods that have happened in the last few days are the perfect illustration of why insurance is so important,? Cobbing said. ?It saves families from ruin.?

Homeowners like Jones, 59, from the town of Keswick in Cumbria, want the government and insurers to settle their differences ? for the benefit of the people and their piece of mind. She urged homeowners to learn their rights ? particularly in terms of what they can ask of insurance companies when they pay claims.

A lot, she says, can be wrapped up in one piece of real estate.

?It?s our home. It?s our business,? she said. ?It?s our children?s inheritance.?

The Dow Jones industrial average rose 36.71 points, or 0.3 percent, to close at 13,021.82.

The?stock?market took a brief turn lower when House Speaker John Boehner said little progress was being made in budget talks in Washington. The Dow was up as much as 77 points in morning trading, turned negative as Boehner made his remarks at 11:30 a.m., then slowly recovered in the afternoon.

Investors were encouraged by several positive economic reports, including a higher estimate of third-quarter U.S. economic growth, an increase in home sales and a drop in claims for unemployment benefits.

After a meeting with Treasury Secretary Tim Geithner, Boehner told reporters that Democrats still haven't said which cuts they would accept to government benefit programs, suggesting a final budget deal remains a long way off. Republicans have said that they are open to increasing tax revenues as part of an agreement but only if they're accompanied by significant cuts to spending.

Investors have been closely watching the talks between the White House and Congress over the "fiscal cliff", a reference to sharp government spending cuts and tax increases scheduled to start Jan. 1 unless a deal is reached to cut the budget deficit. New developments in the talks have whipsawed the market.

"It's a headline-watching market with this fiscal cliff," said David Brown, chief market strategist of the investment research firm Sabrient Systems.

Brown says the ongoing negotiations are likely to cause the?stock?market to take sudden turns in the weeks ahead. "But things seem to be moving in the right direction," Brown said. "I don't think either party wants to get pinned with hurting the market or the economy."

In other trading, the Standard & Poor's 500 rose 6.02 points to 1,415.95. The Nasdaq composite index gained 20.25 points to 3,012.03.

In the market for government bonds, the yield on the 10-year Treasury note slipped to 1.62 percent from 1.63 percent late Wednesday.

Stock?in Guess gained 55 cents to $25.81 after the clothing maker joined the ranks of companies pledging special dividends to shareholders before favorable tax rates on dividends expire at the end of the year. The clothing company said it will make a one-time payment of $1.20 per share on top of its regular quarterly dividend of 20 cents.

Dividends, now taxed at 15 percent, will be treated like ordinary income next year unless Congress and the White House extend current tax breaks as part of a budget deal.

The Commerce Department raised its estimate for U.S. economic growth to an annual rate of 2.7 percent in the July-through-September period. That's much better than the 2 percent rate estimated a month ago and more than twice the 1.3 percent rate logged in the three previous months.

The Labor Department also reported that the number of Americans applying for unemployment benefits dropped to 393,000 last week, in line with what economists had expected. It was the second straight drop after Superstorm Sandy drove applications higher earlier this month.

Target, The Gap, and others retail stores posted poor sales numbers, driving their?stocks?lower. It's a crucial time for retailers, who log a huge chunk of their yearly profits in the weeks running up to the holidays.

Among other companies making news:

? Kohl's plunged 12 percent, the biggest drop in the S&P 500 index. The company posted a drop in sales and said stores in the Mid-Atlantic and the Northeast, areas hit by Superstorm Sandy, fared the worst. Kohl's?stocklost $6.13 to $45.02.

? Kroger Co. rose $1.19 to $26.25 after the supermarket chain reported stronger quarterly profits and raised its earnings outlook for the year. Stronger sales helped the operator of Fred Meyer and Food 4 Less stores post better results than analysts had expected.

Pioneer updates AV receivers with HTC Connect support

Android CentralPioneer has announced that it's updating firmware on its range of 2012 networked AV receivers with support for HTC Connect streaming capabilities. Announced back in June, Pioneer's HTC Connect support lets users with HTC smartphones stream multimedia content to supporting Pioneer devices, similar to the way HTC's own Media Link HD works.

Pioneer is the first manufacturer to roll out HTC Connect support. Currently-supported AV receiver models include VSX-822-K, VSX-1022-K, VSX-1122-K, VSX-42, VSX-60, SC-1222-K, SX-1522-K, SC-61, SC-63, SC-65, SC-67 and SC-68.

On the HTC side, phones supporting HTC Connect include the One X, One S, EVO 4G LTE, Droid Incredible 4G LTE, One X+, One VX and Droid DNA. On early 2012 phones like the original One X and One S, you'll want to make sure you're running the latest firmware update before attempting to use HTC Connect.

Pioneer says supported devices can be updated through a network update or via a manual update method using a USB drive.

If you are a Gmail user, those days could be over. ?On November 27th, Google announced it is providing integration between Gmail and the Google Drive service. ?What that means is that now a Gmail message will be able to send an attachment that is up to 10GB. ?That's right, 10GB. ?I honestly cannot remember a time that I ever needed to send a file that large? and I've sent some pretty big files in my day.

If you are a Gmail user, you should know that the new integration will only with Google's new Compose Format, but that isn't a big deal.

I can remember when Gmail was invitation only and I was thrilled to finally get my invite. ?I knew, even back then, that there would be some cool things to come along with it.

As I've said here before, it's becoming a Cloud based world and tons of our data is going to be there sooner as opposed to later. ?Now we've got one more reason to embrace the Cloud for all of this stuff since Google Drive is a Cloud base storage service (which I happen to use and like, but i also use and like Amazon's service as well).

Court: 1-year suspension for Ohio St. case lawyer

COLUMBUS, Ohio (AP) ? The Ohio Supreme Court on Wednesday suspended for one year the law license of an attorney whose emails to Jim Tressel triggered an ongoing scandal and NCAA investigation that cost the football coach his job at Ohio State University.

At issue was whether Columbus attorney Christopher Cicero violated professional rules of conduct that prohibit revealing information from meetings with a client or a prospective client.

The 5-2 court decision followed the recommendation of a disciplinary board that argued Cicero wrongly discussed interviews with tattoo parlor owner Edward Rife, a potential client. However, the court overruled the board's recommendation for a six-month suspension.

Cicero sent emails to Tressel in April 2010, warning him that players were selling memorabilia or trading them for tattoos. The email traffic sparked the scandal and ended Tressel's Ohio State tenure.

An NCAA investigation also led to a bowl ban this year, reductions in scholarships and the loss of Ohio State's $389,000 share of the Big Ten bowl pot a year ago. The entire 2010 season also was vacated.

Ohio State just completed a 12-0 season and is ranked No. 4 in the AP poll.

Justice Judith Lanzinger said the case went to the heart of the importance of confidentiality between a prospective client and an attorney.

"Prospective clients trust that their confidences will be protected when they engage in an initial consultation with an attorney," Lanzinger wrote. "Cicero's almost immediate dissemination of the detailed information that Rife provided on April 15 directly violated that trust."

Justices Evelyn Lundberg Stratton and Terrence O'Donnell dissented, saying they would have imposed a six-month suspension.

"Cicero's intentions were not for personal aggrandizement or personal gain, as found by the majority, but were to alert the coach about misconduct by his players that could affect the team," Stratton wrote.

"His request that such information be held confidential does not support the notion that he was trying to seek fame," she said.

Cicero's lawyer said he was disappointed with the decision, saying he and his client had considered even a six-month suspension "a little harsh."

"We ended up losing for a year a really, really great lawyer who practices in a difficult area ? felony criminal law," said attorney John Gonzales.

He didn't know Cicero's plans for the year, adding they hadn't expected the decision so soon.

Cicero met with Rife on April 2, 2010, according to court documents, and again 13 days later to discuss whether Cicero would represent him in a federal drug trafficking case, according to a complaint against him by the Disciplinary Counsel of the Ohio Supreme Court.

Cicero, an Ohio State football player in the early 1980s, denied meeting with Rife on April 2. He said the two did meet on April 15, 2010, with the goal of confirming that Rife's partner, a former client of Cicero, wasn't involved with drug dealing or memorabilia sales.

Rife's house had been raided April 1 by federal drug investigators and Cicero wanted to know if Joseph Epling, his client and Rife's business partner, was involved in the case.

"Eddie Rife was never going to be my client in this case at all," Cicero told a three-member disciplinary panel at the Ohio Supreme Court last year. "I saw him as an ally and resource for Mr. Epling. That's how I viewed Mr. Rife's purpose in my office."

Rife pleaded guilty to drug trafficking and money laundering last year and was sentenced to three years in prison.

It was emails Cicero sent to Tressel in April 2010, warning him that players were selling memorabilia or trading them for tattoos, that helped launch the scandal.

In those emails, Cicero seemed to make it clear that he may have taken on Rife as a client.

"If he retains me, and he may, I will try to get these items back," Cicero wrote in an April 16, 2010, email.

"I have to sit tight and wait to see if he retains me, but at least he came in last night to do a face to face with me," Cicero wrote later that day.

Cicero and his attorneys argued the emails sent to Tressel were only meant to warn the coach about his players' actions and shouldn't be read as a breach of confidentiality, since ?they argued ? Rife was not a client.

Ohio's legal conduct rules generally prohibit attorneys from divulging any information they received from someone who might be a prospective client.

News of the memorabilia sales emerged in December 2010. In March 2011, the university discovered that Tressel had known about the sales since the previous April and said nothing. That was a violation of both NCAA rules and Tressel's contract, which required the prompt reporting of any knowledge of such player infractions. Tressel resigned under pressure in May 2011.

LONDON (Reuters) - British pension providers are asking insurers to identify people likely to die young in a bid to reduce the amount of retirement income they have to pay out.

Pension trustees ask people to provide private medical information. The data is then given to an insurer which may take on the brunt of the liabilities of the pension scheme if it believes members will die shortly after retirement.

So-called enhanced buy-ins are gaining traction for defined-benefit pension plans which promise staff a pension based on salaries. A deal allows a pension plan to transfer the risk of people living longer than expected to an insurer.

"We have found pension plans can save between 15-20 percent using an enhanced buy-in over a traditional insured approach," said Will Hale, director of corporate partnerships at pension provider Partnership, one of the few insurers quoting on enhanced buy-in transactions.

Insurers are targeting pension schemes heavy with expensive executive pensions or those with about 300 members and liabilities of 30-50 million pounds ($48-$80 million) - usually made up of blue-collar workers - to try to weed out the unhealthy and bring down the cost of an insurance transfer deal.

Pension plans ask members to answer a handful of questions requiring a 'Yes/No' response and to give permission for insurers to request a medical report from their doctor.

Insurers may then underwrite the scheme, based on the health information volunteered by the employees.

Hale said Partnership have quoted on more than 50 schemes.

"We are hopeful we will complete the first deal in the next few months," he said.

Currently, around 3-5 billion pounds of business per year is completed via traditional pension transfer deals under which liabilities are transferred to an insurer. Pension consultants expect 10 percent of that market could become enhanced annuities in the near future.

Critics of enhanced buy-ins say the move will distort the marketplace and make it harder to insure healthy members of the scheme.

"It creates a non-level playing field if one insurer has obtained far more information than other insurers", said Jay Shah, co-head of origination at Pension Insurance Corporation.

"Traditional insurers are reluctant to quote on these transactions."

When I? first started receiving emails from other gurus one of the main things that? really turned me off was the solicitation for their info products in every email? I received. It just seemed self-centered and pushy, which is why I vowed never? to implement that type of strategy.

What I strongly recommend you do is subscribe to 4 or 5 different gurus and? collect a week?s worth of their email series. This will give you a great idea on? how to write good copy when you develop your email series. I?ve always lived by? the philosophy that you should do what the best are doing, rather than what they? are telling you. It has seemed to work out so far in my online efforts so I? doubt I?ll change that mind-set any time soon.

I want to share a story with you before I end this post. The reason I share? this is because it was one of those ?moments of impact? that occurred to me in? my online journey. I had received an email from a powerhouse guru in my early? learning stages which invited me to a seminar on how to utilize internet? marketing with MLM. I signed up by registering and eagerly awaited the webinar a? few days later. The email had promised all the answers I would ever need to? build a successful online business. When the webinar started I sat through? approximately 20 minutes of ?here was my struggle? storytelling before getting? to any detail (this is very common, unfortunately). The last 30 minutes of the 1? hour webinar basically outlined a ?made-up? strategy with fancy equations? explaining how to go about succeeding online. However, no details were really? offered.

What a waste of time, right? Oh, and I almost forgot, the last 2 minutes? offered an info product with the ?exact strategy? necessary to win. Can you? guess what my thoughts were? If you said ?bite me? you?d be correct. I asked? myself, is this really how these guys are doing this and making all this money?? From that point on I VOWED, I mean seriously VOWED, NEVER to do that to anyone.? See you don?t have to do EVERYTHING the gurus do to be good at marketing, just? the things that resonate with you.

The most interesting part of the webinar was the fact that it was set up for? interacting with the host near the end for a Q&A type session. This allowed? viewers to type in questions and get answers from the host. The moment of impact? I referred to earlier occurred when I actually had a chance to converse with the? guru (who actually did answer my questions).

Below I outline a generic script of what was said:

Jason: So do you do house plans or actually sit down with people as part of? your marketing efforts?

Guru: No, I haven?t done that in years, it?s too slow.

Jason: How do you train your leaders and really get to know them then?

Guru: I don?t. I focus on building a huge list and exploiting it.

Jason: Oh?

I probably should have left at that point, but finished out the seminar. I? had to digest the exchange and figure out what he really said before finally? realizing all he really cared about was exactly what he said: exploiting people.? Now I?ll be the first to admit seminars are extremely effective from what I?ve? seen. With that being said though, there is definitely an honest, and dishonest? way of hosting them. I recommend giving people exactly what they want in a? webinar. But that?s just me, so I guess I?m just a little old-fashioned?

To summarize what a great email marketing strategy looks like I?ve bulleted? what I think are important points below:

  1. Subscribe to 4 or 5 guru email series and study them in detail.
  2. Build your own 30 day email series for your cold market and warm market.
  3. Sign up for an autoresponder like Aweber or iContact.
  4. Begin building your? list through the marketing means you most enjoy. Blogging, article marketing,? solo ads, apps, podcasting, etc.
  5. Offer great value to your list in each? email, helping them solve some problem they are facing. Limit the amount of? pushiness you incorporate into your emails. Connect with them personally and? respond to 1 on 1 emails when you have time.
  6. Have fun and be honest!

'Fiscal cliff' talks stalled but progress possible

WASHINGTON (Reuters) - U.S. lawmakers have made little progress in the past 10 days toward a compromise to avoid the harsh tax increases and government spending cuts scheduled for January 1, a senior Democratic senator said on Sunday.

The United States is on course to slash its budget deficit nearly in half next year. Closing the gap that quickly, which in Washington is referred to as going over a "fiscal cliff," could easily trigger a recession.

"Unfortunately, for the last 10 days, with the House and Congress gone for the Thanksgiving recess ... much progress hasn't been made," Dick Durbin, the No. 2 Senate Democrat, told ABC's "This Week" program.

Serious negotiations are expected to resume this week. Democratic and Republican lawmakers have been trying to convince the public - and financial markets - that they are willing to compromise and can reach a deal before the end of the year.

Durbin indicated Democrats might accept a reform of the government's Medicare health insurance program for the elderly that would make higher-income seniors pay more for their care.

Democrats traditionally oppose limiting Medicare benefits according to income, a practice known as "means testing." Durbin said Medicaid, a public health insurance program for the poor, also could be overhauled.

But Durbin said Social Security, the federal government pension program, needs only small tweaks to ensure long-term solvency rather than major reforms.

A deadline looms over the talks. Without action by lawmakers and President Barack Obama, roughly $600 billion in tax increases and spending cuts will start to hit households and companies in early January.

'TEST OF POLITICAL COURAGE'

Republicans are averse to Democrats' plan to raise income tax rates on the wealthiest Americans, which Republicans say would hurt job creation.

Republicans also want to cut spending on social programs more than Democrats say they will accept.

House Speaker John Boehner has called for a short-term plan to avert the fiscal cliff to pave the way for Congress and the White House to agree to work during 2013 on comprehensive tax reform and longer-term spending cuts.

But Republican Senator Bob Corker said both sides need to show "political courage" and reach a bigger $4 trillion deficit reduction deal that includes both increases in revenues and cuts in spending by the end of the year.

"Kicking the can down the road ? setting up a process for token deficit reduction today with the promise of more reforms later ? is misguided and irresponsible and shows a total lack of courage," Corker wrote in an editorial in the Washington Post.

TAX REVENUES

A growing group of Republican lawmakers are loosening their ties to Grover Norquist, the anti-tax activist famous for getting elected officials to sign a pledge that they will vote against any tax increases.

Republican Senator Lindsey Graham said Republicans will allow tax revenues to rise as long as social spending programs are reformed. "I will violate the pledge - long story short - for the good of the country, only if Democrats will do entitlement reform," he told "This Week."

Graham said he supported boosting revenues by closing tax loopholes rather than by raising tax rates.

Republican Senator Saxby Chambliss said last week he "cared more about the country" than a 20-year-old pledge. On Sunday, Republican Representative Peter King, chairman of the House Homeland Security Committee, told NBC's "Meet the Press" he agreed with Chambliss.

While income tax breaks have attracted the most scrutiny, lawmakers also need to come to terms on a host of other tax incentives that are set to expire at the end of the year, including an estate tax break.

Senator Max Baucus, the chairman of the Senate Finance Committee and a key player in fiscal cliff talks, told a newspaper in his home state of Montana that he wants to preserve the estate tax break, which is important for farmers who want to pass down land worth millions of dollars to their children.

Baucus also said he hopes to preserve the production tax credit for wind energy, he told the Great Falls Tribune.

Investor sues HP over Autonomy deal

SAN FRANCISCO -- Hewlett-Packard was sued on Monday by an investor who claimed the company knew statements about its Autonomy acquisition were misleading and led the stock to fall, according to lawyers representing the plaintiff.

The proposed class action lawsuit was filed in a San Francisco federal court.

HP dropped a bombshell last Tuesday with an $8.8 billion write-down on its acquisition of British software firm Autonomy, saying the company inflated sales with improper accounting. Autonomy co-founder Mike Lynch has denied any wrongdoing.

HP bought Autonomy for a hefty $11.1 billion last year. HP has said it alerted regulators on both sides of the Atlantic.

The lawsuit, one of the first to be filed by investors on the Autonomy mess, said HP hid the fact it gained control of Autonomy based on financial statements that could not be relied upon. It also said that HP had not revealed to investors that it tried to undo the Autonomy agreement before it closed because of the accounting issues.?
